Federal Contractors Challenge Background Checks in Court

Bill Bransford, partner at Shaw Bransford & Roth P.C., a federal employment law firm, was interviewed on Federal News Radio's Federal Drive show to discuss a Supreme Court case, NASA v. Nelson, No. 09-530, brought by federal contractors who challenged the use of employment background checks. The interview is available here.

Excerpt: If you're a federal employee hired since 1953, your background has been investigated. It's a matter of course for federal employees. But since 9/11, starting in 2005, federal contractors have been going through the same security checks.

The Supreme Court on Monday agreed to referee a dispute between NASA and some of its independent contractors over those security checks, a decision that could affect how the federal government investigates the background of current and future employees.
